These Terms & Conditions apply to tuition provided by Rochelle Marsh, trading as RCM Languages (“RCM Languages”, “I”, “me” or “my”).
For the purposes of these Terms & Conditions:

“Client” means the person who books tuition and is responsible for payment. This may be a parent or guardian booking on behalf of a child, or an adult student booking tuition for themselves.

“Student” means the person receiving tuition.
By booking tuition with RCM Languages, the Client agrees to these Terms & Conditions.
1. Tuition Services
RCM Languages provides online language tuition, including:
-
individual (“1:1”) tuition;
-
GCSE group tuition; and
-
occasional one-off or taster lessons.
Tuition is delivered online via Google Meet, unless another arrangement has been expressly agreed.
Standard 1:1 lessons are 60 minutes. Longer lessons, including 90-minute or two-hour sessions, may be arranged where appropriate and subject to availability.
Group lessons are 55 minutes in duration. The number of lessons included in each block varies by term and will be clearly stated before booking.
2. Enquiries and Taster Lessons
Initial enquiries and informal discussions about tuition are free of charge and carry no obligation to book.
Free trial lessons are not offered.
A one-off 1:1 taster lesson may be booked at the standard rate of £55 per hour.
Where availability permits, a group taster session may occasionally be offered at £25 for 55 minutes. Availability of group taster sessions is not guaranteed.
3. 1:1 Tuition Fees and Payment
The standard fee for 1:1 tuition is £55 per hour. The cost of longer lessons will be calculated or agreed accordingly.
Regular 1:1 tuition is invoiced monthly in arrears, at the end of each calendar month. Invoices must be paid within 7 days of the invoice date.
Payment should be made using the payment details provided on the invoice.
RCM Languages reserves the right to pause future tuition where an invoice remains outstanding until payment has been received.
Existing Clients will normally receive at least one month's notice of any change to their tuition rate.
4. 1:1 Cancellations and Rescheduling
At least 24 hours' notice must be given if a Client wishes to cancel or rearrange a 1:1 lesson.
Where at least 24 hours' notice is provided:
-
the lesson may be rearranged, subject to availability; or
-
the lesson may be cancelled without charge.
Where less than 24 hours' notice is provided, the full lesson fee remains payable.
If a Student does not attend a scheduled lesson without prior notice, the full lesson fee remains payable. I will normally remain available on Google Meet for 15 minutes after the scheduled start time. If the Student has not joined or made contact within this time, I may leave the meeting and the lesson will be treated as a missed lesson.
If a Student arrives late, the lesson will still finish at the originally scheduled time and the full lesson fee remains payable.
If a Student chooses to end a lesson early, the full scheduled lesson fee remains payable.
5. Regular 1:1 Tuition
There is no requirement to commit to tuition for a fixed period.
Clients may end regular 1:1 tuition at any time. Where possible, I ask for two weeks' notice as a matter of courtesy so that the regular lesson slot can be offered to another Student. This is a request rather than a contractual notice requirement.
I will endeavour to maintain an agreed regular lesson time, but a particular weekly slot cannot be guaranteed indefinitely.
Where lessons are cancelled frequently, even where sufficient notice is given, I reserve the right to stop holding a regular lesson slot and instead arrange future lessons subject to availability.
Tuition may be arranged during school holidays where mutually convenient. Tuition is not guaranteed to be available every week or throughout the year, and I will give reasonable notice of planned periods of unavailability where possible.
6. Group Tuition: Booking and Payment
Group tuition is booked in blocks.
The full cost of the block must be paid in advance, and a Student's place is not confirmed until payment has been received.
Places are limited and are reserved specifically for the Student named at the time of booking. A place may not be transferred to another person without prior agreement.
A minimum of two Students is required for a group to run.
If the minimum number of Students is not reached, I reserve the right to cancel the group. In this situation, Clients will receive a full refund of any fees paid for tuition that will not take place.
Booking one block does not automatically guarantee a place in a subsequent block. Existing Students may be offered priority booking, but each new block must be booked separately.
7. Group Cancellations and Refunds
If a Client wishes to withdraw a Student from a group, they should notify me as soon as possible.
Where cancellation is made more than 7 days before the first lesson of the block, fees paid for future tuition will normally be refunded.
Cancellations made within 7 days of the start of the block will not normally be eligible for a full refund. This is because a limited place has been reserved for the Student and it may not reasonably be possible to fill that place at short notice.
Any amount retained following a cancellation will be reasonable and will take account of the actual loss resulting from the cancellation and any reasonable steps that can be taken to reduce that loss, including whether the place can be offered to another Student.
Your statutory rights
The cancellation arrangements above are separate from any cancellation rights the Client may have under consumer law.
Where a booking qualifies for a statutory cancellation period, including the 14-day cancellation period that generally applies to qualifying contracts entered into at a distance, the Client may exercise those rights in accordance with the law.
If the Client asks for tuition to begin before the end of an applicable statutory cancellation period, tuition may begin on the agreed date. If the Client subsequently exercises a statutory right to cancel, they may be required to pay for any tuition already provided up to the point of cancellation, where permitted by law.
Nothing in these Terms & Conditions affects the Client's statutory consumer rights.
8. Missing a Group Lesson
If a Student is unable to attend an individual group lesson, the lesson fee is not refundable or transferable and no credit will normally be provided.
Where appropriate, lesson resources or materials will be made available afterwards so that the Student can catch up independently.
If a Student arrives late, the group lesson will still finish at the scheduled time.
9. Cancellation by RCM Languages
If I need to cancel a 1:1 lesson, I will endeavour to rearrange it at a mutually convenient time. If this is not possible, the lesson will not be charged or, where payment has already been made, the appropriate amount will be refunded or credited.
If I need to cancel a group lesson, I will endeavour to rearrange the session. Where this is not reasonably possible, the appropriate fee for the affected lesson will be refunded or credited.
I may cancel an entire group where there are insufficient enrolments or where there is another genuine reason that makes it impracticable for the group to proceed. Where prepaid tuition is cancelled by me and cannot reasonably be rearranged, the Client will receive an appropriate refund.
10. Technical Difficulties
Students are responsible for having a suitable device, internet connection and the necessary equipment to participate in online tuition.
Where a lesson cannot proceed because of technical difficulties at the Student's end, the lesson will normally remain chargeable.
Where a lesson cannot proceed because of technical difficulties at my end, I will endeavour to rearrange the lesson. Where this is not possible, the affected lesson will not be charged or will be appropriately refunded or credited.
Where a lesson is disrupted by a widespread or unavoidable technical problem outside either party's reasonable control, reasonable efforts will be made to rearrange the affected tuition.
11. Online Lesson Expectations
Students should:
-
join lessons punctually;
-
participate from an appropriate study or communal space where reasonably possible;
-
avoid participating from a bedroom where reasonably practicable;
-
be appropriately dressed;
-
behave respectfully and appropriately;
-
use lesson technology responsibly; and
-
follow reasonable instructions necessary for the safe and effective delivery of tuition.
Students are normally expected to have their camera switched on during both 1:1 and group tuition. Reasonable exceptions may be made where appropriate, including where individual circumstances or additional needs make this difficult.
For younger Students, a responsible adult should be reasonably accessible during online tuition, although parents and guardians are not normally required to remain in the room or participate in the lesson.
12. Lesson Links and Online Security
Google Meet links and other access details provided for tuition are intended only for the Student for whom the lesson has been arranged.
Students and Clients must not share lesson links with other people or permit an unauthorised person to join a lesson or group session.
13. Communication with Students Under 18
For Students under 18, administrative matters including bookings, payments, cancellations and significant changes to tuition arrangements should normally be handled through the Student's parent or guardian.
Students may communicate with me directly through my RCM Languages email address where reasonably necessary for legitimate educational purposes, including asking questions about their work, submitting work or accessing lesson resources.
RCM Languages maintains social media accounts for business and promotional purposes. Social media direct messages are not used as a routine channel for private communication with Students under 18. If a Student contacts RCM Languages through social media, educational communication may be redirected to the RCM Languages email address and administrative matters to their parent or guardian.
I will not use personal social media accounts to communicate privately with Students under 18.
Communication with Students will remain professional, appropriate and related to tuition at all times.
14. Recording Lessons
Clients and Students must not make audio, video or screen recordings of lessons without my prior permission.
I will not record a lesson involving a Student under 18 without obtaining the appropriate prior consent.
Any agreed recording arrangements will be handled in accordance with applicable safeguarding and data-protection requirements.
15. Behaviour and Conduct
Students are expected to behave respectfully towards the tutor and, in group tuition, towards other Students.
Abusive, threatening, discriminatory, sexually inappropriate or otherwise seriously unacceptable behaviour will not be tolerated.
I reserve the right to end a lesson immediately where behaviour makes it inappropriate or unsafe for tuition to continue.
In cases of serious or repeated misconduct, I may terminate tuition or remove a Student from a group. Where prepaid group tuition remains, any refund or amount retained will be determined fairly in light of the circumstances, the tuition already provided and any actual loss resulting from the Student's removal.
16. Students with SEND and Additional Needs
Students with SEND, disabilities and additional learning needs are welcome.
Clients are encouraged to tell me about any additional need, disability, medical consideration or other circumstance that is relevant to tuition so that reasonable and appropriate adjustments can be considered.
Disclosure is not a condition of receiving tuition, but providing relevant information can help me ensure that lessons are as accessible and effective as possible.
Where I reasonably believe that a particular group environment is not suitable for a Student's individual needs, I may discuss alternative arrangements with the Client, including a different group or 1:1 tuition. There is no obligation to take up 1:1 tuition with RCM Languages.
17. Educational Progress and Results
I will provide tuition with reasonable care and skill and will tailor teaching appropriately to the service that has been agreed.
However, no particular examination grade, school result, qualification, level of progress or other educational outcome can be guaranteed.
A Student's progress depends on a range of factors outside my control, including attendance, engagement, completion of independent work, prior knowledge and individual circumstances.
Homework or consolidation activities may be provided. Students are strongly encouraged, but are not contractually required, to complete these tasks unless otherwise agreed.
18. Examinations and Schoolwork
Unless expressly agreed otherwise, RCM Languages is not responsible for registering Students for examinations, arranging examination centres or meeting examination-entry deadlines on a Student's behalf.
I may support Students with homework, coursework, examination preparation and other academic work, but I will not complete assessed work or schoolwork on a Student's behalf.
Students remain responsible for ensuring that work submitted to their school, examination centre or other institution is their own and complies with the relevant academic rules.
19. Teaching Materials and Intellectual Property
Worksheets, presentations, lesson notes, revision materials and other resources created or supplied by RCM Languages are provided for the Student's personal educational use only, unless otherwise stated.
Materials must not be sold, published, uploaded publicly, reproduced commercially or distributed to others without prior permission.
Some lessons may make use of third-party educational resources, websites or services. While reasonable care will be taken when selecting these resources, I cannot guarantee the continued availability or operation of third-party services.
20. Google Drive and Digital Resources
Students may be provided with access to a personal Google Drive folder or other digital resources during tuition.
Access to these resources is guaranteed only for the period during which the Student is receiving tuition. Access may remain available afterwards at my discretion, but Students should download or retain any materials they wish to keep before tuition ends.
21. Ending Tuition by RCM Languages
I reserve the right to end tuition where there is a reasonable and legitimate reason to do so.
Where possible, reasonable notice will be provided.
Tuition may be ended immediately in serious circumstances, including:
-
abusive, threatening or seriously inappropriate behaviour;
-
serious or repeated breaches of these Terms & Conditions;
-
safeguarding concerns;
-
persistent non-payment; or
-
circumstances in which continuing tuition would no longer be appropriate or safe.
Any prepaid fees relating to tuition that will not be provided will be dealt with fairly according to the circumstances and the Client's statutory rights.
22. Circumstances Outside Reasonable Control
Neither party will be responsible for a failure or delay caused by circumstances genuinely outside their reasonable control.
Where such circumstances prevent a lesson from taking place, reasonable efforts will be made to rearrange tuition where practicable.
Nothing in these Terms & Conditions excludes or limits any liability that cannot lawfully be excluded or limited.
23. Complaints and Concerns
I aim to provide a professional, supportive and high-quality tuition service.

I will aim to consider and resolve concerns promptly, reasonably and fairly.
24. Changes to These Terms & Conditions
These Terms & Conditions may occasionally be updated to reflect changes to the tuition service, business practices or applicable requirements.
Material changes affecting ongoing regular 1:1 tuition will be communicated with reasonable notice.
Changes will not retrospectively alter the agreed terms of a group block that has already been purchased, unless required by law or expressly agreed with the Client.
25. Governing Law and Consumer Rights
These Terms & Conditions are governed by the law of England and Wales.
If the Client is a consumer living elsewhere in the United Kingdom or another jurisdiction, nothing in these Terms & Conditions is intended to remove any mandatory consumer protections that apply to them.
Nothing in these Terms & Conditions excludes, restricts or overrides any rights the Client has under applicable consumer law.
